QUESTION NO. 4

QUESTION: Councillor E. Tuffy

To ask the Manager for a report on the number of fines issued to householders in the Lucan EA in 2011 to-date for presenting household bins in a manner which contravenes the Council's Bye-Laws, the percentage of fines paid and the percentage appealed to the Council, and the outcomes of appeals?

REPLY:

Details of Fixed Payment Notices issued pursuant to SDCC Presentation, Storage and Collection of Household Waste Bye-Laws, 2007 for the Lucan EA in 2011 to date are as follows:-

Fines issued were 25 of which 6 could not proceed leaving 19 fines.

Of the 19 fines still active, 16% were paid (3), 84% currently unpaid (16)

Of the 19 fines 31% appealed (6). Appeal Denied 66.6% (4).  Appeals Granted 33.3%  (2)

The purpose of SDCC Storage Presentation and Collection for Household Waste Bye-laws 2007 is to prevent the theft, overloading, spillage, abuse and/or vandalism of bins causing potential threat to the enviornment.
