That this Committee condemns the granting of planning permission to the HSE primary care facility and nursing home at Boot Road / Fonthill Road junction despite the level of local opposition.

REPORT:

A decision to grant planning permission was made on 4 November’11 for the development referred to in the motion, for an integrated healthcare facility at Boot Road - Fonthill Road junction,  following submission of Further Information. The decision to grant permission for this development is open to appeal to An Bord Pleanála until 1st December’11;  the Planning Department are therefore precluded from commenting further on this matter at this time. However, the process for assessing planning applications is set out in the paragraph below.

In making its decision on a planning application, the planning authority is restricted to considering the proper planning and sustainable development of an area, having regard to the matters provided for in section 34 of the Planning Act. Section 34 sets out in detail the considerations which the planning authority must take account of, including the provisions of the development plan, Guidelines issued by the Minister for the Environment, Community and Local Government, other relevant Ministerial or Government policies and any submissions or observations made in accordance with the Planning Regulations.  In determining any planning application, all valid third party submissions received are considered in the planning assessment of the proposed development.
