QUESTION NO. 2

QUESTION: Councillor M. McDonagh

To ask the Manager for a report into the ongoing legal case being taken by South Dublin County Council and GAMA in relation to the construction of Méile an Rí, Tór an Rí and Búirg an Rí?

REPLY:

There were 5 proposed phases of construction in the Balgaddy scheme overall - Balgaddy A (Búirg An Rí), Balgaddy B (Méile An Rí) Balgaddy C (Méile an Rí), Balgaddy D (not constructed) and Balgaddy E (Tór an Rí).  They were constructed by GAMA Construction Ltd. as main Contractor, under a GDLA81 Government Contract for each phase.

Gama Construction was required under the contracts to address outstanding building faults in each phase and they have done this in the majority of cases.  Due to other problems arising - availability of Gama staff, emergency procedures, inability to address defects etc., some of the necessary works are being carried out by South Dublin County Council maintenance staff and their contractors.

The cost of these works has been offset (as provided for in the contracts) against monies owing to Gama Construction on phases of the scheme for which final accounts have been agreed i.e. Balgaddy A and B.  Agreement to final account has been reached with Gama and is awaiting approval from the Department of the Environment, Community and Local Government in relation to Balgaddy E.  Negotiations with Gama are ongoing in relation to Balgaddy C.

There are sufficient offset funds available to the Council under this process to complete all outstanding defects under the extensive programme of investigations and consequent works which have been undertaken over the past year, and are continuing on site by a dedicated team under the direction of the County Architect.
