QUESTION NO. 7

QUESTION: Councillor B. Bonner

To ask the Manager to present a report on the issue of a shopkeeper trading on the street in front of his shop at Main Street, Clondalkin.  I am aware that this issue has been raised at area committee meetings before.  What action can be taken in this regard and what action has been taken.  Many residents and a number of residents groups have raised this issue with me.  On a related matter, a resident has complained that the interior of the shop is unsafe as it is so jam packed with goods it is hard to get around it.  Is there any regulation on this kind of matter.

Detailed background information in relation to the above has been provided in previous replies.  In summary,  7 Final Notices were served on offenders under Section 71 of the Roads Act, 1993 in the Clondalkin Village area in 2010.  Following an operation carried out by Council Officials in conjunction with the local Gardaí in July 2010 a significant improvement was observed generally in the area.  Subsequent informal inspections continued on a regular basis and while minor infringements were  noted, generally there was an overall marked improvement.

A further round of formal inspections on all premises was carried out in March 2011 and again a significant improvement was observed generally in the area.  2 Final Notices were served on offenders on Main Street, Clondalkin and 1 Verbal Warning issued on a premises on Orchard Road.

As part of ongoing informal monitoring, a number of infringements have recently been noted.  It is proposed to carry out formal inspections on all premises found to be in breach of Section 71, where non-compliance may ultimately result in goods/structures being seized.

It is not possible to target premises on an individual basis where adjoining premises are equally in breach of the provisions of the Roads Act.
