QUESTION: Councillor W. Lavelle

To ask the Manager to provide to the elected members, without any further delay, the legal advice which members were informed at the Transport SPC meeting of the 19th May 2011 was being prepared by the Law Agent on the status of weight restrictions attached by an Bord Pleanala, by way of condition, to the consents for the Grange Castle Road (Outer Ring Road)?

REPLY:

This matter has been  examined by the Law Agent who  considers that given the complexity of the legal issues involved it would be prudent to seek the advice of Senior Counsel on the matter.  It is expected that this advice will be obtained before the December or January County Council meeting.
