QUESTION: Councillor J. Lahart
"To ask the Manager to update the Committee on any inspection the Conservation Officer may have carried out on Marlay Grange, since it was severly damaged by fire?"
REPLY:
A Section 59 Endangerment Notice was served on the owner of Marlay Grange House during August 2010. Under the provision of the Planning and Development Act 2000 (Part IV) an 8 week period from the date of the notice is provided for the works required under the notice to be carried out. After the 8 week period the Councils Conservation Officer tried several times by phone to contact the owner of the property to arrange access for a site inspection so that she could confirm if the safety works required under the S59 Notice were carried out.
At that time a number of phone calls were made to the owner and an email was sent to the owners business address but no response was received. The Conservation Officer also visited the site during March 2011 but the main gates were locked and access to the site could not be gained at this time. During April 2011 correspondence were re-issued and were sent to 3 no. address that we have on file for the owner again requesting site access. No reply has been received to date. In September 2011 a letter was received by the Conservation Officer from the owners business address on behalf of the owner stating that Marlay Grange had been placed on the market for sale. The Conservation Officer has tried to make contact by phone with the person who issued the letter and has left several messages asking that the Conservation Officer be contacted so that access to the site can be provided to carry out a site inspection. Efforts to inspect the property shall continue.
