HEADED ITEM: 7. Waste Bye-laws
REPLY:
South Dublin County Council made Bye-Laws pursuant to Section 35(1) of the Waste Management Act, 1996 (as amended) and in accordance with Part 19 of the Local Government Act, 2001. These Bye-l;aws may be cited as the South Dublin County Council Storage, Presentation and Collectin of Household Waste Bye-laws 2007.
Given the significant changes to the Household Waste Collection Market since the making of the Bye Laws in 2007, it is considered appropriate that they be reviewed having regard to Waste Food Regulations 2007, currently not governed by Bye-laws , changing government policy and the revised role of SDCC following the sale of the Household Waste Collection service in April 20ll from an operational role to one of enforcement.
In 20l0 a working sub-group was established on the direction of the Directors of Services from each Dublin Local Authority to examine current bye-laws in each area concerning the presentation and collection of household/commercial waste and to explore the feasability of having a common set of bye-laws across the four authorities.The review is ongoing and to date the following issues have been identified:
1) The specification of the types of collections permitted and also materials acceptable for each collection type e.g. glass and WEE issues.
2) The times permissible for both presentation and collection of waste.
3) The introduction of commercial bye-laws in Fingal & South Dublin.
4) Implication of new commercial and pending household food waste regulations
5) Drafting a common set of interpretations
6) Enforcement of bye-laws.
All of the Dublin Authorities are moving away from the collection of waste and it is appropriate to review the bye-laws in this context. It is therefore proposed to draft a new set of bye-laws for public display and it is recommended that Members of the SPC be involved in that initial drafting process. It is proposed to have a set of bye-laws prepared for the next SPC meeting and therefore that a sub-group be established in advance of that.
