QUESTION: Councillor J. Lahart

"To ask the Manager for an update on the Hermitage View position with regard to the Bank of Ireland?"

REPLY: 

The Roads Department has committed considerable resources to advancing this matter over the last number of years. After exhaustive investigations the Council recently obtained confirmation that the Bank of Ireland legal advisors were willing to examine this case and try and bring it to a conclusion. All relavant information was again forwarded to the bank and over the last number of months there has been on going contact  between the Bank of Ireland and the Roads Department.

Late last year the  Bank of Ireland indicated by email that they were confident that they could set in train the necessary legal provisions to remove their interest from the property and that they would confirm this in writing as soon as they had completed this transaction. A recent communication from the Bank has indicated that this matter is now close to resolution. In anticipation of confirmation of this position, legal advice has been sought as to who is now the beneficial owner of the property as the original company was disolved in 2007. Members will be kept informed as progress is made.

It should be noted that in order to formally take the development in charge it is necessary to have the consent of the owner of the land.
