MOTION NO. 11

MOTION: Councillor T. Delaney

That the Manager presents a report to this Committee on the Council owned site adjacent to no. 1 Church Road, Rathcoole specifically its unkempt condition and whether it is planned to make it available for public use.

REPORT:

This site has been left vacant from the time that the houses at Church Road were built.  It is understood from local residents that the developer had allowed the site to be used as temporary car-parking during construction works at the local church some years ago.  However the site was not dedicated to the Council as part of the public open space lands for the estate or as a public car park.

The owner of the adjoining property constructed a wall around the site some years ago and had initiated a claim for possessory title to the site.  Following a request from local residents at the time the Council investigated the matter and noted that a public sewer crossed through the front section of the site.  Accordingly, the Council pursued the acquisition of the site by way of Deed of Waiver from the Minister for Finance, in whom the title had vested following the Company, who were the registered owners of the land, being dissolved.  The claim for possessory title was deemed abandoned and the site is now registered to the Council.

The wall around the site has not yet been removed pending a decision being made as to the future use of the site. The Council has arranged for a clean up of the site last year and will continue to monitor and maintain the site.
