MOTION: Councillor D. Looney
That this Committee expresses its concern regarding the imposition of unfair fines on residents under the Storage, Presentation and Collection of Household Waste Bye-Laws and that we call for an immediate review of all fines imposed in the area under the remit of this Committee in the interests of natural justice.
REPORT:
Section 7 of SDCC Bye-laws for the Storage, Presentation and Collection of Household Waste provides as follows:
"A waste container presented for collections hall not be overloaded and the lid shall be securely closed. Waste presented at the side or on top of the waste container will not be collected and the presentation of such waste in this manner shall be deemed to be a breach of these Bye-laws by the holder".
Records show that since the introduction of the aforementioned Bye-laws in 2007, a total of 425 fines have issued of which 336 fines issued pursuant to Section 7(d) of the Bye-laws. Of the 336 fines issued pursuant to Section 7(d) 8l of those issued in the period lst January 20ll to 6th October 20ll.
It is proposed to commence an early review of the 2007 Bye-laws for the Storage Presentation and Collection of Household Waste to reflect the role of the Waste Collection Companies operating within the administrative area of this Council.
