MOTION NO. 6

MOTION: Councillor M. Devine

That the Manager agrees to investigate how best to establish procedures that will enable this council record incidents of anti-social behaviour committed by individuals who are in receipt of rent supplement/allowances and are waiting to be allocated council property.

REPORT:

Private Property is beyond the scope of current housing legislation.  For example,  section 35 of the Housing Miscellaneous Provisions Act 2009,  which requires Local Authorities to adopt an Anti Social Behaviour Strategy, does not extend to dwellings in the private rented sector as it is envisaged that policing of tenants in this category is overseen by the Private Rented Tenancies Board. (the PRTB).

However the Council always tries to ensure that prospective tenants of its social housing dwellings, who have previously engaged in anti social behaviour, do not continue to behave in such a manner.  Soon to be appointed tenants are required to attend pre-tenancy training and also need to have a clear Garda check.  If a Garda check is returned showing convictions, the allocation can be deferred for up to two years or longer, until the applicant can demonstrate that he/she has modified their behaviour.

If and when the payment of rent supplement is transferred to the Council the matter will be reviewed at that time.
