QUESTION: Councillor B. Bonner
To ask the Manager why a car park at Church Road, Rathcoole has been closed off by South Dublin County Council? The residents report that this has resulted in cars being damaged etc.
REPLY:
The above site had been left vacant from the time that the houses at Church Road were built. It is understood from local residents that the developer had allowed the site to be used as a temporary car-park during construction works at the local church some years ago. However the site was not dedicated to the Council as part of the public open space lands for the estate or as a public car park.
The owner of the adjoining property constructed a wall around the site some years ago and had initiated a claim for possessory title to the site. Following a request from local residents at the time the Council investigated the matter and noted that a public sewer crossed through the front section of the site. Accordingly, the Council pursued the acquisition of the site by way of Deed of Waiver from the Minister for Finance, in whom the title had vested following the Company, who was the registered owner of the land, being dissolved. The claim for possessory title was deemed abandoned and the site is now registered to the Council.
The wall around the site has not yet been removed pending a decision being made as to the future use of the site. The Council arranged a clean up of the site last year and will continue to monitor and maintain the site.
