"That this Committee requests the Manager to detail the process followed with regard to planning enforcement notices following the refusal of retention of planning permission at details supplied and to detail the timeframe adhered to by the Council on such matters and the actions to be undertaken by the unsuccessful applicant."

REPORT:
Under SD09A/0211 permission was granted for significant alterations to a previously approved dwelling on site which was granted under SD06A/0875. Under Reg Ref SD10A/0317 permission was refused on the 16th December 2010 to retain certain elements which departed from that granted permission under SD09A/0211, in particular the increase in the ridge height of the structure relative to the adjoining structures.
A revised planning application for retention was lodged on 25th March 2011 under Reg. Ref SD11B/0107 for “Retention of alterations to house granted under SD09A/0211 including: two additional rooflights and small extension to rear (south) elevation; an additional rooflight to front (north) elevation; reconfiguration of window on ground floor to the side (west) elevation and lowering of finished ground floor level”
A decision was made on 18th May 2011 to grant permission, the appeal period of which has yet to expire.
Notwithstanding the above, the Planning Enforcement section has investigated a breech of conditions attached to SD09A/0211 and has sought to resolve the matter. In order to comply with Condition No. 1 of planning permission granted under Reg. Ref SD09A/0211 the landowner has given an undertaking to remove the roof and replacing it at a lower pitch, as per the permission granted.
The lands at this location will continue to be monitored and should the matter not be resolved to the satisfaction of this Planning Authority, it is open to South Dublin County Council to take the necessary enforcement action
