QUESTION NO. 21

QUESTION: Councillor W. Lavelle

To ask the Manager to provide a further update and likely timescale for the taking-in-charge of Larkfield and Mount Bellew estates, both of which were developed by the same builder; noting in particular that in reply to my question at the October 2010 meeting it was advised that with respect to Larkfield that “a final inspection of these works is due this month to identify if public areas are ready for taking in charge"?

REPLY:

A final inspection took place in respect of both of the above developments and in March 2011 a list of the works outstanding was issued for immediate attention of the developer, Fitzgibbon Bros. and the bond issuing company.

Following the expiration of the period for the completion of works the Council notified the bond issuing company of the failure to complete and requested that the Council be provided with the funds from the bond to complete works.

The developer has failed to carry out works and the bond issuing company has failed to provide the required funds. The Council therefore has indicated its intention to initiate proceedings against the bond issuing company to force them to honour the terms of the bond and has requested their response in this matter.

On the basis that proceedings may issue it is difficult to anticipate when the matter may conclude and when the development will be completed to an acceptable standard to enable taking in charge.
