QUESTION: Councillor W. Lavelle
To ask the Manager to report on investigations into residents’ concerns regarding allocation of commercial parking spaces at Rosse Court?
REPLY:
Following receipt of complaints, an investigation was carried out in relation to the allocation of car parking spaces adjacent to Rossecourt Supermarket, Balgaddy.
A Warning Letter pursuant to Section 152 of the Planning & Development Act 2000 (as amended) issued to the Owner/Occupier of Rossecourt Supermarket on the 18th May 2011 in relation to alleged unauthorised development consisting of the following:
(i) Change of use of 12 No. communal off-street car parking spaces (4 No. spaces x 3 No. locations) adjacent to Rossecourt Supermarket, Block B, Building Group 5, for the sole benefit of customers visiting the supermarket.
(ii)Material change of use of lands for the exhibition of 3 No. road markings for the benefit of direction/warning, fronting 3 No. locations x 4 No. off-street car parking spaces adjacent to Rossecourt Supermarket, Block B, Building Group 5, with text referring to “ROSSECOURT SUPERMARKET PARKING”,
All without the benefit of planning permission.
As a person served with this letter the owner/occupier may make submissions or observations in writing to the Planning Authority regarding the above (which, if true, would constitute an offence under the Planning & Development Acts, 2000 (as amended ) not later than four weeks from the date of the service on the owner of the Warning Letter, i.e. 17th June 2011.
Should the Planning Authority, following investigation, consider that the above described or other unauthorised development has been carried out, it may decide to issue an Enforcement Notice under Section 154 of the Planning and Development Act, 2000 (as amended).
The Councillor will be kept updated as matters progress.
