PROPOSED EXTINGUISHMENT OF THE PUBLIC RIGHT OF WAY OVER LANEWAY TO THE SIDE OF 266 & REAR OF 229, KILLINARDEN ESTATE, TALLAGHT, DUBLIN 24. MAP REF: RE 1101
The attached report was CONSIDERED at the Tallaght Area Committee Meeting (2) on Monday 18TH April, 2011.
Following consideration of the report it was proposed by Councillor M. Corr, seconded by Councillor C. King and AGREED:
“That this committee recommends to the Council that the public right of way over laneway to the side of 266 & rear of 229, Killinarden Estate, Tallaght, Dublin 24, as shown shaded red on Map Ref: RE 1101 be extinguished.”
The decision regarding the extinguishment of a public right of way is a reserved function of the Council.
If the Council agrees to the recommendation, the following resolution is required.
“South Dublin County Council in pursuance of its power under Section 73 of the Roads Act, 1993 hereby orders that the public right-of-way over laneway to side of 266 & rear of 229, Killinarden Estate, Tallaght, Dublin 24, as shown shaded red on Map Ref: RE 1101 be extinguished.”

PROPOSED EXTINGUISHMENT OF THE PUBLIC RIGHT OF WAY OVER LANEWAY TO THE SIDE OF 266 & REAR OF 229, KILLINARDEN ESTATE, TALLAGHT, DUBLIN 24. MAP REF: RE 1101
The following report was submitted to the Tallaght Area Committee Meeting on Monday, 24th January, 2011.
“The laneway to the side of 266 and rear of 229, Killinarden Estate as shown shaded red on Map Ref: RE 1101 has been the scene of various forms of anti-social behaviour. To address this issue, the residents of houses adjoining the laneway i.e. houses 229, 230, 231, 232 and 266 have indicated their support for the extinguishment of the public right of way over this laneway. The proposal is to incorporate the laneway into the gardens of 266 and 229 Killinarden Estate.
The Development Department have agreed terms of disposal with the residents of these two houses.
If the Committee agree the Procedure to Extinguish the Public Right of Way as listed above will be initiated.”
Following consideration of the report, it was agreed to initiate the procedure.
The proposal to extinguish the public right-of-way was advertised in the Echo on Thursday 10th February, 2011 and signs were erected on site in accordance with Section 73 of the Roads Act, 1993. The latest date for receipt of objections, representations and requests for an oral hearing was Tuesday 29th March, 2011.
No submissions were received.
Public Lighting have reported there is 1No. Public lighting column which is located within the laneway adjacent to No.266. This column will have to be disconnected and removed.
Water & Drainage Sections have no objections to the proposal.
Housing Maintenance have no objection to the incorporation of laneway.
Bord Gais have no gas mains present.
Eircom have no services in the laneway.
UPC have no issue with this proposal.
ESB have no objections but request that they are contacted before any works commence.
It is proposed to incorporate the laneway into the gardens of 266 and 229 Killinarden Estate. The Development Department have agreed terms of disposal with the residents of these two houses.

Any recommendation of the Committee will be brought to the attention of the Council.
