QUESTION: Councillor E. Tuffy
To ask the Manager for an updated report on compliance of the owners of the property (address supplied), to enforcement letters/notices regarding restoration of garden walls etc.?
REPLY:
An Enforcement Notice dated 9th April 2010 was served on the owner of the lands requiring the following:
That where no permission has been granted, that the development cease.
And within the specified period commencing 13th April 2010 and ending 22nd June 2010 to take the following steps:-
(i) Re-erect the front and eastern side boundary walling and railing, save as for the provision of a pedestrian access, to "address supplied" to a height not exceeding 1.2 metres, wall to be capped and finished externally in stone to match adjacent walling.
(ii) Cease the material change of use of the hard surfaced area to the front of "address supplied" as an area for off-street car parking in connection with the adjoining shop and reserve its use solely for a use incidental to the enjoyment of the dwellinghouse at "address supplied.
(iii) Cease and discontinue the material change of use of the front amenity area of "address supplied" for the display of an advertising sign relating to “Razo Indian Pakistani Arabic Groceries.”
(iv) Remove the free-standing advertising sign erected in the north-west corner of the front of "address supplied", relating to “Razo Indian Pakistani Arabic Groceries.
As the Enforcement Notice dated 9th April 2010 had not been complied with, legal proceedings were initiated .
An inspection of the lands carried out on the 26th January 2011 found that the Enforcement Notice dated 9th April 2010 had been substantially complied with. Accordingly, when this matter came before the district court on the 8th February 2011, the case was struck out with an order for the Council's costs.
