DRAFT REVIEW OF BYE-LAWS FOR THE CONTROL AND REGULATION OF THE USE OF PARKS, OPEN SPACES AND RECREATIONAL PLAYING GROUNDS OWNED, CONTROLLED BY, OR IN THE CHARGE OF SOUTH DUBLIN COUNTY COUNCIL

The power to make a Bye Law which is a reserved function is determined under Section 199 of the Local Government Act 2001.
The procedures for making a Bye Law are specified under Section 200 of the Local Government Act 2001. "Not less than 2 months before a Local Authority makes a Bye Law, the Local Authority shall publish a notice in one or more newspapers circulating in the area to which the proposal relates". (a) Indicating that it is proposed to make a Bye Law and stating its general purpose and where appropriate, that provision is to be made for the imposition of fixed payments.
As a result of the substantial social, cultural and policy changes which have taken place since the current Bye-laws came into force in 1996, the Council’s Parks Department is undertaking a complete review of the Bye-laws to ensure that they are up to date and reflective of the issues that now face the Management and users of the Council’s parks, open spaces and recreational playing grounds.
