MOTION NO.14

MOTION: Councillor J. Lahart

That this Council urges the incoming Minister for the Environment to introduce legislation giving protection to  contractors and sub-contractors produced by Senator Feargal Quinn in the previous Seanad and that this be done without delay

REPORT:

Senator Quinn introduced a Private Members Bill in the Seanad over a year ago, it was passed by the Seanad on 08th March 2011.  

The Bill is entitled Construction Contracts Bill 2010 and  is intened to improve payment practices and much needed cashflow in the constuction industry, particularly aiding sub-contractors by providing for a mechanism whereby prior notice of an intention to withhold sums from payments otherwise due to contractors must be given. Otherwise, payments must be made in full and/or the payee may suspend the provision of works and/or services under the construction contract until payment is made in full.  The Bill also intends to provide for an alternative dispute resolution mechanism.

If the motion is passed the sentiments of the members will be conveyed to the Minister for Finance who has responsibility for this area. When a reply is received a copy of the response will be circulated to the members.
