QUESTION: Councillor W. Lavelle
To ask the Manager to provide a further update on the responses from the land-owner of the site at Coolamber House, Lock Road to the serving of statutory notices under the Derelict Sites Acts and by the Dangerous Places Section under the Sanitary Services Act?
REPLY:
This site was inspected by the Area Engineer, under the Derelict Sites Act, 1990 and was found to be in a derelict state. A Section 11 Notice was issued to the registered owner listing a number of works to be completed in order to render the site non derelict. On expiry of this notice a re-inspection was carried out, and, as all the works had not been completed, a Notice was issued to the owners notifying them of the Councils intention to enter the site onto the Derelict Sites Register, the owners were given 28 days to make representations to the Council. As no representations were received, a Notice was issued to the owners informing them that the site was entered onto South Dublin County Council's Derelict Sites Register on 17th December, 2010.
The site was then valued and a Notice of determination of market value was issued to the registered owners. They had 28 days to make an appeal to the Valuation Tribunal, no appeal was made, however, the owners representative has been in contact with the Council to advise that some works have taken place on this site. The Area Engineer has been liaising with the owners representative in relation to this matter and a further inspection of the site is being undertaken.
