"That this Committee discusses with the aid of a full report, the plight of the sub-contractors on The Boherboy Water Scheme – how many were not paid by Pierce Construction; has any settlement been made."

REPORT:

South Dublin County Council (SDCC) had a contract with Pierse Contracting Ltd for the Boherboy Water  Supply Scheme. In line with the contract, monthly payments were made to Pierse Contracting. Any sub-contractors/suppliers employed through Pierse Contracting were in contract with Pierse and not South Dublin County Council. As a result, responsibility for payment of those sub-contractors lies with Pierse Contracting. The detail of these relationships or the number of sub-contractors/suppliers affected is not known to the Council. These sub-contractors must settle their claims with the Liquidator.

A number of sub-contractors were nominated by the Council through the main contract. A clause under the main contract allows the Council to make payments directly to those nominated sub-contractors. Such payment have been made where possible.
