MOTION NO. 11

MOTION: Councillor J. Lahart

That this Council considers the merits and legality of introducing bye laws requiring house occupiers to clear snow from driveways and footpaths in front of their homes to maintain the grass verges in front of their homes

REPORT:

The Council considers it prudent that householders should clear snow and ice from their driveways and from the footpaths in front of their homes and in the course of the recent severe weather events issued advices in that regard. If this work is to be undertaken then householders should ensure that it is carried out in a manner which does not cause a danger and with due consideration for all users of the public domain. The overall manner in which this work should be carried out is at present part of the overall ongoing review of our responses to the recent severe weather events. The need for the introduction of a legal mechanism to require a mandatory response needs very careful consideration especially in regard to the physical capability of individual householders to undertake what can be a very physical task.

If the motion is passed the Council's Law Agent will be consulted to examine the mechanisms for the drafting and introduction of such a byelaw. The making of any Bye Law is a matter reserved to the Members of the Council.
