QUESTION: Councillor W. Lavelle
To ask the Manager to provide an update on the response from the land-owner of the site at Coolamber House, Lock Road, to the serving of statutory notices under the Derelict Sites Acts and by the Dangerous Places Section under the Sanitary Services Act?
REPLY:
The site at Coolamber House, Lock Road, Lucan, Co Dublin was inspected by the Area Engineer on the 21st September, 2010, and was found to be in a derelict state. A Section 11 Notice was issued to the registered owners listing a number of works to be completed in order to render the site non derelict.
The site was re-inspected on the 17th of November, 2010 and it was found that not all the works outlined in the Section 11 Notice had been completed, therefore, a Section 8(2) Notice was issued to the registered owners notifying them of the Council's intention to enter the site on the Derelict Sites Register and the owners were given 28 days to make representations to the Council. No representations were received, therefore, a Section 8(7) Notice was issued to the owners advising them of the entry of this site on the Derelict Sites Register.
A Section 22 Notice of Determination of Market Value of Urban Land, has now been issued to the registered owner who had 28 days to make an appeal to the Valuation Tribunal. In the event that there is no appeal the Council propose to apply a Derelict Sites Levy in this case.
