Proposed Extinguishment of the Public Right of Way over Portion of Kilcronan Crescent, Clondalkin

REPLY:

The following report was submitted to the Lucan/Clondalkin Area Committee Meeting on Wednesday, 15th September, 2010.

“The Council constructed three units of accommodation at Kilcronan Crescent, Clondalkin, as part of an infill development of 56 units.  The addresses of these houses are as follows:-

17 Kilcronan Grove,

78A Kilmahuddrick Road, and

1A Kilcronan View.

Portion of these 3 units were constructed on part of the public road at Kilcronan Crescent as shown shaded red on Drawing RE:1046.  Accordingly, to regularise matters it is necessary to extinguish the public right-of-way over that portion of Kilcronan Crescent shown shaded red on Drawing RE 1046.”

Following consideration of the report, it was agreed to initiate the procedure.

The proposal to extinguish the public right-of-way was advertised in the Echo on Thursday 30th September, 2010 and signs were erected on site in accordance with Section 73 of the Roads Act, 1993.  The latest date for receipt of objections, representations and requests for an oral hearing was Monday 15th November, 2010.

No submissions were received.

The decision regarding the extinguishment of a public right-of-way is a reserved function of the Council. 

The recommendation of the Committee will be brought to the attention of the Council.
