QUESTION NO. 9

QUESTION: Councillor R. Dowds

To ask the Manager to give an updated report on the sewage coming from 5 Orchard Road, Clondalkin - a problem which has been ongoing for three and a half years - and indicate

(a) why this problem was not resolved earlier and

(b) when it is going to be resolved?

REPLY:

This matter has been investigated on numerous occasions by the Council's Drainage Maintenance Section and it has been established that this is a combined drain serving 5 Orchard Road, Clondalkin only. There are no other householders served by this drain.  This is the responsibility of the owner to resolve.  The owner has been advised on what remedial action to take in this regard.  It would appear that there is damage done to the pipe as a result of rods being placed down the system to unblock the drain.  The owner was advised by the Council's Drainage Inspector to contact a contractor to have these works carried out. 

The owner was also contacted by the Environmental Health Office following on from complaints received from the public and the local GP.   An Abatement of Nuisance Notice under Section 110 of the Public Health (Ireland) Act 1878 is currently being prepared requiring the abatement of this nuisance within seven days.  The Notice requires that the blockage is cleared and that the owner carry out the required repairs to the drain in front of 5 Orchard Road, Clondalkin, Dublin 22.  If the nuisance is not abated the matter will be referred to the Council's Law Department instructing them to initiate legal proceedings in this regard.
