MOTION NO. 2

MOTION: Councillor J. Lahart

"That this Committee supports management in taking the strongest measures available to them in dealing with alleged serious anti-social behaviour directed at residents of Taylor's Court, Ballyboden."

REPORT:

This matter relates to disputes which have arisen amongst former friends who are the tenants of Council properties at Taylors Court, Ballyboden.  The Council has been dealing with these disputes for up to 5 years and has amongst other potential solutions arranged for professional Mediation between the parties and also offered transfers to the tenants to alternative accommodation in the Rathfarnham area.  Unfortunately none of the foregoing interventions appear to have been successful and the disputes have culminated in at least two Court actions which are due to be dealt with by the District Court over the coming weeks.

It was hoped that a decision of the District Court on 9th December would dictate the course of action to be followed by the Council but unfortunately the case had to be adjoured due to the illness of a Garda who was due to give evidence in the case.  It is understood that this case will be dealt with again on 13th January 2011.

It is further understood that a separate court action involving the same tenant may be due for hearing on 14th December 2010.

Until these matters have been dealt with by the courts it is not consided appropriate to make any further comment but the members of the Committee may be assured that if any of the tenants are found guilty of having engaged in anti social behaviour against their neighbours the full powers available to the Housing Department under the Anti Social Behaviour Strategy will be utilised.
