To ask the Manager, to date, how much monies has been paid in compensation to SDCC by Gama Construction in relation to housing defaults and maintenance problems in Balgaddy?
REPLY:
There were 5 proposed phases of construction in the Balgaddy Scheme overall - Balgaddy 'A' (Buirg an Rí), Balgaddy 'B' (Méile an Rí), Balgaddy 'C' (Méile an Rí), Balgaddy 'D' (not constructed), Balgaddy 'E' (Tor an Rí). They were constructed by Gama Construction Ltd. as main Contractor, under a GDLA81 Government Contract for each phase. To date South Dublin County Council and Gama Construction have completed a Contract Conciliation process on phases Balgaddy 'A', 'D' and 'B'. No agreement has been reached to date on the Final Account of Balgaddy 'C' and 'E'; it is likely they will also end in dispute and the necessity for a Conciliation / Arbitration process to complete Final Accounts.
Gama Construction were required under the contracts to address outstanding building faults in each phase and they have done this in the majority of cases. Due to other problems arising - availability of Gama staff, emergency procedures, inability to address defects etc. - some of the repairs were carried out by South Dublin County Council maintenance staff and their contractors. The costs of these repairs have been offset against monies owing to Gama Construction on Balgaddy 'A' to a total of €141,431.00 excl VAT. The Final Account for Balgaddy 'B' has not been approved to date by the Department of Environment and the offset here is delayed as a result. There is no offset in Balgaddy 'D' which was not constructed. Phases 'E' and 'C' remain in negotiation.
