MOTION: Councillor J. Lahart
"That the Manager give an update on the taking over of Hermitage View as raised by me a number of years ago - the Manager had made contact with the Bank of ireland but has not updated the Committee for a number of meetings."
REPORT:
The Law and Roads Departments have pursued this issue over the last number of years with a view to taking the area in question in charge subject to the approval of the members. In order to begin the taking in charge process it is necessary to obtain the agreement of the owner of the land. It has transpired that the land was originally owned and developed by the Gallagher Group who went into liquidation. The Council made proposals to the liquidator but they did not supply the necessary authorisation for us to proceed prior to the land passing to the Bank of Ireland as mortgagee. The Council have now been informed that the Bank of Ireland as the mortgagee in possession of the lands would have to issue the authorisation for the area to be taken in charge.
A letter has been issued to the Bank of Ireland's Legal Department asking for the relevant authorisation. The details of the reply will be brought to the attention of members at the next available meeting once it is received.
