Re: Proposed Transfer of lands at Greenhills Road – Calmount Road to BWG Foods Limited.
South Dublin County Council Compulsory Purchase (Greenhills Road – Calmount Road Reconfiguration) Order 2007 was made on 23rd July 2007. Notice of Confirmation was served on all landowners 18th June, 2008. Notice to Treat was served on 17th November, 2009.
The owners of Plot 9 identified on Drawing No. CPO-20-Rev G in grey and purple – BWG Foods Limited lodged a claim for compensation which was subsequently referred by the owners to the property Arbitrator. However the Councils Valuer entered into negotiations and has agreed a figure of €1.2m in respect of compensation for Plot 9. The payment of this amount however is subject to the transfer of the area coloured green to the west of Plot 9, having a gross area of 991 sq. m. or thereabouts in exchange for the area hatched green having an area of 1585 sq. m. or thereabouts to the South of Plot 9 (severed lands owned by BWG). The lands coloured green are required as part of the accommodation works to facilitate the replacement of circa 32 car parking spaces which BWG Foods Limited will loose within Plot 9, when acquired for the scheme.
The land to be transferred (coloured green) is currently owned by Dublin City Council, who have approved its transfer to South Dublin County Council as part of a separate land transfer. The registration of the land to South Dublin County Council is awaiting completion. It is proposed to transfer the land to BWG Foods Limited, on completion of the registration of title.
Accordingly the Council proposes to transfer the site coloured green on Drawing No. CPO-20-Rev G having a gross area of 991 sq. m or thereabouts to BWG Foods Limited in accordance with Section 211 of the Planning and Development Act, 2000, Section 88 of the Housing Act, 1960 and subject to the Provisions of S183 of the Local Government Act, 2001 in exchange for the area hatched green (severed lands owned by BWG Foods Limited) having an area of 1585.4 sq. m or thereabouts of which 236 sq. m or thereabouts is roadbed.
