Update on signage at Killinarden Heights – Kelland Homes

 

A Warning Letter pursuant to S152 of the Planning & Development Act 2000 (as amended),  issued to Kelland Homes on the 5th October 2010, in relation to unauthorised development consisting of the erection of a steel sign approx. 15ft, advertising a Kelland Homes Development at the above location, without the benefit of planning permission.

Subsequently, an inspection was carried out on the 11th October 2010 which identified three more unauthorised signs in the vivinity and a further S152 Warning Letter issued to Kelland Homes on the 20th October 2010 .

The four signs are located as follows:

 ·On the entrance pillar to “Dungloe” house, Fortunestown Lane,

·On the N81, adjacent to the entrance to Hazel Hill

·At the eastern site entrance to the actual development on Killinarden Heights,

·Adjacent to Cushlawn Park at the roundabout of Whitestown Way, Kiltipper Way and Firhouse Road West.

In accordance with the Planning Act the developer may make submissions or observations in writing to the Planning Authority regarding the above  not later than four weeks from the date of the service of the Warning Letters,, i.e.  3rd and 19th November 2010.

If the above described other unauthorised development remains after these dates Enforcement Notices under Section 154 of the Planning and Development Act, 2000 (as amended) will issue.

This matter has also been referred to the Council's Environmental Services Department for investigation under Litter Control Legislation.

The Development Department have  been requested to prepare a reference report on the lands and have also been requested to carry out an investigation on any signage that may be erected on Council owned lands.
