QUESTION NO. 2

QUESTION: Councillor S. Crowe

"To ask the manager can she/he give an update on the continued breach of planning and Development Act 2000 and unauthorised development taking place in the  Cloonmore area of Tallaght and measures this Council has taken to resolve this issue and if the legal proceedings initiated by this Council will be heard this year?"

REPLY: 

The Council has instructed the Law Department to take Circuit Court injunction proceedings in this matter and a Section 160 Warning Letter which was served on the owners of the above lands on 1st September 2010 requiring within 7 days of receipt of this letter to

(i)                  Cease the use of the caravans as dwellings,

(ii)                Cease and discontinue the use of the lands for the keeping of caravans

(iii)               Remove the caravans from the lands,

And within 21 days of receipt of this letter to

(iv)              Reduce the hardstanding area so that it can accommodate the parking of not more than two vehicles or for a purpose incidental to the enjoyment of the house,

(v)                Restore the remaining area of the front and side garden to an area of soft or hard landscaping and

(vi)              Remove all resultant debris to an approved landfill site or salvage yard.

These proceedings must be taken against all occupiers of the lands, as well as on the owner, and are therfore likely to take some time. It is not possible to give a precise timescale at this stage in the proceedings.
