QUESTION NO. 5

QUESTION: Councillor C. Keane

"To ask the Manager if there has been a response to the many requests made to the Bank of Ireland by the Law Department re the transfer of the road at Hermitage view to SDCC with a view to taking it in charge. We have impressed upon them the seriousness of the situation. The roads department cannot upgrade this work until this is rectified. Any update on this please, and if not what is the next step, taking into consideration the Bank of Ireland have been written to many times?"

REPLY:

Both the Roads and the Law Departments have been in contact with the Bank of Ireland who now have control of the lands in question due to the liquidation of the original developers Gallagher Group.

The most recent discussions took place on 6/10/10 and the solicitor dealing with the case on behalf of the Bank of Ireland indicated that they could see no reason why the area in question could not be offered to the Council for taking in charge purposes. It is agreed that further discussions will take place over the next number of weeks with a view to finalising matters and to enable the Bank of Ireland to formally request that the Council take the area in charge. As part of this process the Bank of Ireland are to give written authorisation to the Council to enter onto the lands to carry out any necessary works to bring the road up to the taking in charge standard. It will of course be a matter for the Members of the Council to declare the road to be a public road at the conclusion of the process.
