MOTION NO.2

MOTION: Councillor C. Brophy

That this Area Committee calls on the Law Department in conjunction with the Parks Department to immediately resolve the ongoing issue concerning the title of green space/public open space within Kingswood Heights and given the fact that a deed of dedication exists for these lands and the freehold was recently purchased by a third party, that the matter be resolved as soon as possible so that there is absolute certainty concerning the public ownership of these lands and the matter be discussed.

REPORT:

A meeting was recently held between the Parks Department and the current owners of the public open space lands, previously dedicated to the County Council, in the Kingswood area. Whilst the County Council is not in a position to compel the owners of these lands to transfer the freehold title, it has been agreed that a suitable mechanism for conveying full ownership of these lands to the County Council, would be implemented as soon as possible.
