MOTION NO. 13
MOTION: Councillor D. Looney
"That this Committee, as a matter of road safety, supports the introduction of a ban on large vehicles, in particular buses, from Fernhill Road, Mountdown Park and the remainder of Manor Estate (except for access)".
REPORT:
The Council is empowered to provide weight restrictions on public roads under Section 17(1) of the Road Traffic (Traffic & Parking) Regulations 1997. The regulations state:
“where traffic sign No. RUS 015 is provided at the entrance to a road, the driver of a vehicle, the unladen weight of which exceeds the weight specified on the sign, shall not proceed beyond the sign”.
A 3 Ton Weight Restriction currently exists from Keadeen Avenue along Lugnaquilla Avenue, Kippure Avenue and Limekiln Road to its junction with Mountdown Park. However, it should be noted that under the terms of Section 17(2) sub-article (1):
" such a restriction shall not apply where it is necessary for a vehicle to enter a road solely for the purpose of gaining access to or egress from premises accessible only from that road”.
A request for the provision of a 3 Ton Weight Restriction on Fernhill Road was previously examined by the Traffic Section in July of 2009. The provision of a Weight Restriction was not recommended at that time. Having monitored the situation, and re-examined same, the numbers of HGV’s does not warrant the provision of a weight restriction.
