QUESTION: Councillor M. Corr
"To ask the Manager to detail the number of fines/penalties handed to businesses/property owners operating in the shopping centre on the bottom of Sundale Park and, given the persistent and extreme nature of littering at this extreme litter blackspot, what sustainable approach/action is the Manager putting in place to address this appalling problem for the local community?"
REPLY:
The Litter Warden carried out inspections at Sundale Shopping Centre and adjacent areas on 19 occasions between 14/05/10 and 01/07/10.
During this period the Litter Warden spoke with persons in charge of the units in the Shopping Centre enquiring about the litter issues in the area. The litter warden was informed that a person is employed in the mornings to collect litter inside the boundary of the Shopping Centre. It was reported to the Litter Warden that the person was employed by Kelland Homes Ltd, Russell Square Centre, Unit 5, Fortunestown Way, Tallaght, Dublin 24. On foot of this information, the Litter Warden called to Kelland Homes.
Some of the unit operators explained that local youths came into the centre at night to drink, eat and hang out. The Litter Warden observed 2 No. litter bins at Sundale Park and 2 No. CCTV cameras overlooking the area.
Between the 27/05/10 and 01/07/10 the Litter Warden issued 5 No. fines to T/a Kelland Homes, 1 No. fine to T/a Fortunestown Inn, 1 No. Notice to Lidl, Fortunestown Way and 1 No. Notice to Rossfield Stores.
The 5 No. fines issued to T/a Kelland Homes were not paid within the period specified under the Act (21 days) and legal proceedings pursuant to Section 25 of the Litter Pollution Act, 1997, as amended have been authorised. These files have been referred to the Council's Law Dept. The 1 No. fine issued to T/a Fortunestown Inn was not paid within the period specified under the Act (21 days) and a reminder has been sent.
The litter warden has reported that the Notices issued to Lidl, Fortunestown Way and Rossfield Stores, Brookfield Road, have been complied with. The litter warden observed that there are 5 street litter bins along Brookfield Road (at the shop, school, and bus stop).
The Litter Warden continues to monitor this area.
