QUESTION NO. 21
QUESTION: Councillor D. Looney
To ask the Manager to make a report on the status of all sites included on the Derelict Sites Register within South Dublin, including details as to the ownership, the date entered, the role of the Council in each case and the Council's understanding as to future proposals for each site?
REPLY:
The following are a list of derelict sites on the Councils Derelict Sites Register:
Address of derelict site | Owner | Date entered on register |
1. Former Shopping Arcade, St James Road, Walkinstown, Dublin 12 | McHugh Management Company | 19/12/2008 |
2. Site to the rear of 10 College Drive, Manor Avenue, Terenure, Dublin 6 | William JP Egan | 31/05/2010 |
3. Former Esso garage site, Main Street, Tallaght, Dublin 24 | Esso Ireland Limited | 09/07/2010 |
Members will be aware the Council is pursuing a Derelict Sites levy of €60,000 from the registered owner of the site of the former Shopping Arcade, St James Road, Walkinstown, Dublin 12. The Council must now bring a Motion to the High Court seeking to obtain Judgment. The Law Department is preparing the Notice of Motion and Grounding Affidavit at present.
The site to the rear of 10 College Drive, Manor Avenue, Terenure, Dublin 6, was entered onto the derelict sites register in May and a Section 22 Notice was issued to the registered owner who had 28 days to make an appeal to the Valuation Tribunal. No appeal was made, Section 23 of the Derelict Sites Act, 1990, states that a Notice demanding a levy, can only be issued on a site which stands entered on the register on the first day of January of that local financial year, therefore a Section 23 Notice demanding a levy on this site will be issued to the registered owner in January, 2011
The site of the former Esso garage, Main Street, Tallaght, Dublin 24, was entered onto the derelict sites register in July and a Section 22 Notice was issued to the registered owner who had 28 days to make an appeal to the Valuation Tribunal.
