Proposed disposal of portion of laneway at rear of  7 Tymon North Green, Tallaght, Dublin 24 to Mr. Stephen Cooper.

 An application has been received from Mr. Stephen Cooper, 7 Tymon North Green to acquire a portion of laneway to the rear of  his property.  A similar request has also been received from the owners of No 8  Tymon North Green and is being considered seperately. The remaining portion of rear laneway from No 8 upwards has already been incorporated into the adjacent properties and accordingly the disposal of the portion now requested by the owners of No 7 & 8 Tymon North Green would not block access to any other properties.

 The matter was referred to the Council’s Valuer for examination and he has recommended terms which he considers to be fair and reasonable.

 Accordingly, I now recommend that the Council dispose of the portion of laneway measuring 25 square metres or thereabouts to the rear of 7 Tymon North Green, Tallaght, Dublin 24 as shown outlined in red on the attached Drawing No. LA/42/09 to the respective houseowner, Mr. Stephen Cooper subject to the provisions of Section 183 of the Local Government Act, 2001 and in accordance with Section 211 of the Planning & Development Act, 2000, subject to the following terms and conditions as recommended by the Council’s Valuer:-

  1.                 That the Council dispose of  the plot for the consideration of €1,000 (one thousand euro) .

 2.                 That the land is disposed of with full freehold title and vacant possession.

 3.                 That the subject land is not encumbered by any services.

 4.                 That the applicant shall incorporate the area into his rear garden and shall construct a suitable boundary wall, to match and tie into existing boundary walls.

 5.                 That the applicant shall pay Valuers fees of €250 (two hundred and fifty euro).

 6.                 That the applicant shall pay the Council’s legal fees.        

  

The lands being disposed of form part of lands acquired from M. Waterman  in 1975 for housing purposes.
