QUESTION NO. 10
QUESTION: Councillor E. Tuffy
To ask the Manager if he can advise what steps should be taken by a person who wishes to operate a public market on private property in the County, what role the Council has in the matter of permitting/ regulating such markets, and what regulations, such as Health and Safety, Food Safety apply to such markets?
REPLY:
Such markets do not come under the remit of the Council's Casual Trading Bye-Laws which only cover specific sites referred to in the Bye-Laws and prevent casual trading in all other areas. While potential operators of markets may in some instances need to apply for planning permission from the Council depending on the nature and extent of the proposed market, the Council does not have a specific role in regulating markets with regard to areas covered by specific legilstaion where bodies such as the Health & Safety Authority, the Food Safety Authority etc. operate. The Environmental Health Office may also be in a position to advise on certain aspects, again depending on the nature of the market as any person or body, whether private or public, and whether for profit or not ,can produce or sell food provided they are registered with the Health Service Exceutive and such registrations are facilitated by the Environmental Health Office.
It is incumbent upon any such potential operator to fully appraise themselves of appropriate leglislation and to consult with the Planning Department as well as any other relevant agencies as appropriate.
