MOTION NO.3

MOTION: Councillor W. Lavelle

To insert a new section under ‘0.4 General Guidance – Development Management’ as follows:

Approved plans guiding planning consent

Where an approved local plan is required by this Development Plan the approved plan will be a Local Area Plan, a Strategic Development Zone planning scheme or another appropriate masterplan as recommended by the Manager. The type of plan shall be agreed by the elected members prior to the commencement of its preparation.

REPORT:

The proposed amendment if adopted would require that all local plans guiding development management would require to be prepared and adopted in accordance with the statutory procedures laid down in Sections 18 to 20 of the Planning and Development Acts 2000 as amended. It is considered that such a requirement could unduly inhibit the timely preparation of plans, such as urban design framework plans for small areas and sites where no rezoning of land is required.  It is considered that in such cases guidance provided in the form of a non-statutory local plan approved by the elected members would be more expedient.

 

Manager’s Recommendation:

It is recommended that the proposed motion be adopted subject to the following amendment:

Where planning consent for any proposed development within the county is interpreted to have to comply with the guidance, policies and requirement of an approved local plan as required by this Development Plan, the approved plan in question will be either a Local Area Plan or Strategic Development Zone planning scheme as defined by the Planning & Development Acts & Regulations, or a non-statutory local plan approved by the elected members, as appropriate.
