MOTION NO. 4

MOTION: Councillor E. Tuffy

Amend the 1^st sentence of Section 0.4.6, Enforcement, as in the Draft Plan adopted in September 2009 by inserting the word “appropriate” between the words “take” and “enforcement”, delete “where it is appropriate to do so”, and replace “having regard to” with “consistent with”.

REPORT:

Part VIII of the Planning and Development Act sets out the procedures and provisions for dealing with the investigation of unauthorised development. This section of the development plan is a reflection of the legislation as is in force at present.

Manager’s Recommendation:

That this motion not be adopted.
