MOTION NO. 17

MOTION: Councillor W. Lavelle

Motion also proposed by Cllrs C. Brophy & B. Lawlor.

Insert a distinct new policy objective in section 1.3.32 as follows:

It shall be the policy of the council to prohibit development on areas of accessible open space in or adjoining residential estates not currently taken-in-charge by the council where the open space in question was included within the planning application boundary of an adjoining residential development.

This prohibition shall however not apply where all of the following criteria are met:

• The planning application for the original residential development containing the open space was granted within the preceding seven years;
• The open space was not required to meet the planning authority requirements for open space provision for the original residential development;
• The documentation submitted with the planning application for the original residential development explicitly stated that this open space would be subject to a future separate planning application.

REPORT:

It is considered that this motion is negative in nature. Development plan policies and objectives must be positive in their intent. In any case the adoption of this motion could lead to the prejudging of any future planning applications and would not have regard to the current land use zoning provisions of such sites and therefore would not be in accordance with the proper planning and sustainable development of the County.
