QUESTION: Councillor J. Hannon
To ask the Manager to confirm that horses grazing on commonage lands are exempt from the provisions of the Control of Horses Act, and can he therefore also confirm that this exemption extends to any road running through such lands?
REPLY:
There is no provision in the Control of Horses Act 1996 or Bye-Laws 1997 exempting horses grazing on commonage lands or on roads therein from the Control of Horses Act 1996 or Bye-Laws 1997.
Section 3 of South Dublin County Council, Control of Horses Act 1996, Bye-Laws 1997 states that the County of South Dublin is a control area. All horse owners within the County of South Dublin must therefore be in possession of a valid licence. This is set out in the Control of Horses Act 1996, Sec18 (1):
“Subject to section 19, a person who owns a horse which is kept by him or her on his or her behalf in a control area shall, unless he or she holds a horse licence in respect of the horse entitling that owner to keep the horse in the control area, be guilty of an offence.”The Council has powers of entry onto private property set down in the Control of Horses Act 1996, Sec 34 (1).
