MOTION NO.  9

MOTION: Councillor J. Lahart

"That the Manager outline the details of the communications and correspondences between the Roads department and Bank of Ireland re transferring the ownership of the illegal roadway in Hermitage to the Council as first highlighted by me a number of years ago - the reply to include details of the correspondences and communications from the Council in this regard."

REPORT:

The access road to Hermitage View is not in charge of the Council.

The original developers, Gallagher Group have gone into liquidation and it is understood that the land is now under the control of the Bank of Ireland.

The Roads Department are willing to improve the road to taking in charge standards.

The Law Department  has managed to contact a solicitor acting for the Bank of Ireland .He reports that the liquidator who was dealing with the matter is no longer doing so.He undertook to approach the new liquidator and revert to the Law Department on the outcome.

The Law Department have been in recent contact with the solicitor and have impressed upon them the seriousness of the situation .

Enclosed are copies of the most recent correspondence between the Council's Law Department  and the solicitor .The Law Department have also made a number of phonecalls to expedite the matter.

A favourable outcome is expected.
