MOTION: Councillor C. Keane
"That this Committee discusses (with the aid of an up to date researched report) the taking in charge of open space in Stonepark/Longwood with a view to speeding up the process. I was informed last year that this taking in charge would be finalized by early 2010. To state in the report the last time contact was made with the solicitors and the exact reasons for the delay - as residents are of the view the council is being given the 'run around' or that delaying tacticts are being used to prevent the taking in charge."
REPORT:
The history of this particular site relates to planning permissions dating back to the early l980s. The site in question was used as a Builders Compound by the Developer for the Longwood and Stonepark Estates despite a ruling by An Bord Pleanala that it should not be used for this purpose. The open spaces in both Longwood and Stonepark Estates were not officially transferred to the Council unitl 2009. However, the 'compound' open space was not included in that transfer as the full information relating to the site was not avialable at the time. In the meantime the Council has been in touch with the Developer and his Solicitor - the Developer has accepted that the information which the Council has provided relating to the 'compound' site, namely planning permissions relating to the site and the conditions imposed on foot of those permissions including the decision of An Bord Pleanala, clearly indicates that the open space is and always was intended to be used as public open space to be transferred by the Developer on completion of both estates. The Solicitor for the Developer confirmed week-ending 2nd April 20l0 that the documentation in relation to the Deed of Tranfer will be forwarded to the Council no later than Mid April 20l0.
