MOTION: Councillor C. Brophy

That the Manager outline the criteria for a derelict site and explain how the current condition of the Burmagh Garage site should not result in it being declared a derelict site.

REPORT:

Section 3 of the Derelict Site Act, 1990 states the definition of a derelict site as

“derelict site” means any land (in this section derelict site. Referred to as land in question”) which detracts, or is likely to detract, to a material degree from the amenity, character or appearance of land in the neighbourhood of the land in question because of  -

(a)              the existence of the land in question of structures which are in a ruinous, derelict or dangerous condition, or

(b)              the neglected, unsightly or objectionable condition of land or any structures on the land in question, or

(c)              the presence, deposit or colleffion on the land in question of any litter, rubbish, debris or waste, except where the presence, deposit or collection of such litter, rubbish, debris or waste results from the exercise of a right conffered statute or by common law.

The site at the Burmah Garrage, Greenhills, Dublin 12 was inspected by the Area Engineer and was deemed to be in a derelict state.  A Section 11 Notice was served on the registered owner in September, 2009, outlining the following works to be completed:

·        Remove rubbish

·        Remove graffiti

·        Secure site from trespass

The Area Engineer met with the owners and their architects on site on the 29th October and it was confirmed that these works had been completed satisfactorily, therefore the site was rendered non derelict.  The site was inspected again on the 10th March, 2010 and is still considered to be non derelict.
