Planning Applications β Validation Stage and Decision Stage
Introduction
The validation of a planning application and the making of a decision on a planning application are two separate processes.
Validation of a Planning Application
The criteria used to check the validity of a planning application are set out in the Planning and Development Regulations 2001 β 2006 and published on the Council Website.
Such criteria include a newspaper notice, site notice, type of permission sought, a description of the development, legal interest of the applicant, drawings, the relevant fee etc.
Subject to compliance with these criteria, the application is validated.
If the planning application omits any of these criteria, it is deemed invalid and returned to the applicant, along with the fee.
Making a decision on a Planning Application
Once a planning application has been validated, the process of making a decision begins.
The criteria used when making a decision in relation to a planning application are set out in Section 34 (2) of the Planning and Development Act 2000 (as amended). The planning authority shall be restricted to considering the proper planning and sustainable development of the area, regard being had toβ
(i) the provisions of the Development Plan,
(ii) the provisions of any special amenity area order relating
to the area,
(iii) any European site or other area prescribed for the
purposes of section 10(2)(c), e.g. Special Area of Conservation.
(iv) where relevant, the policy of the Government, the
Minister or any other Minister of the Government,
(v) the matters referred to in subsection (4) relating to conditions to be
imposed, and
(vi) any other relevant provision or requirement of the
Act, and any regulations made there-under.
