QUESTION: Councillor P. Kearns
"To ask the Manager if he could confirm ownership of the lane way between Beechfield Close and Whitehall Road West? And will he advise a group of residents on what action they need to take to follow through on the closure of the lane way. Due to the constant anti social behavior and damage to private property, could closure of this lane way be progressed as soon as possible?"
REPLY:
Ownership of this laneway cannot be easily established as this laneway is unregistered in Land Registry.
In order to examine this matter it is necessary that a petition be forwarded to the Roads Department, signed by individual residents (together with a map of the laneway) indicating support for the proposal to extinguish the public right-of-way.
The petition should include the reasons for the closure. It will be necessary for the residents to indicate the method of closure and that they will be responsible for all works, including any costs involved, in effecting the closure. On receipt of this information the matter will be examined.
Should the residents have any queries regarding the extinguishment procedure they can contact the Roads Department directly to discuss same.
The decision to extinguish a public right-of-way is a reserved function of the Council.
