MOTION: Councillor E. Maloney

That the Manager present a report on the compliance of the By-Law on the removal of graffiti by home owners and business proprietors for 2009.

REPORT:

While Section 19  of the Litter Pollution Act, 1997 as amended onliges property owners to ensure that their property is free of graffiti, it is necessary to deal with graffiti in the context of the fact that it is ordinarily unlikely that property owners will have willingly engaged in or allowed such graffiti on their premises.  Accordingly, the Environmental Services Department's policy is to arrange for local Anti-Litter Wardens to inspect complaints of graffiti in the first instance and, where such graffiti is on private property, the Wardens will engage with the owners reminding them of their obligations under legislation and offering assistance where possible and within the context of available resources.

Where this approach does not yield the appropriate response, there is recourse to issuing notices and fines under the Act but it was not necessary to resort to these measures during the course of 2009.
