MOTION NO. 9

MOTION: Councillor C. Keane

"That this Committee discusses the consultation process/timescale of the Draft Parking Bye-Laws, many constituents complaining that the Christmas period was not a suitable period and that the consultation period should be extended. Legislation provides for a minimum statutory consultation period not a maximum. SDCC are entitled to discuss and consult with citizens at any time and that this issue be discussed in order to ensure the Bye-Laws are not open to be struck down by a court “for want of form or process."

REPORT:

The duration provided for the public consultation is prescribed in Section 36 of the Road Traffic Act 1994. In considering the public consultation period any public holidays are noted. Holiday periods can also afford members of the public time to inspect relevant documents and to develop a submission that would otherwise not have been the case. The period over Christmas and New Year was additional to the required public consultation duration.

The adoption of the Control of Parking Bye Laws is a reserved function of the Council and very careful consideration of the substantial number of submissions received will be afforded in the report to be presented to the members. As previously indicated this report will be discussed informally with the members of each Area Committee before formal presentation to a meeting of the Area Committee for endorsement and referral to a meeting of the full Council. Members can be assured that the prescribed statutory processes and procedures will be followed in the making of the Bye Laws.
