QUESTION NO.  2

QUESTION: Councillor S. Crowe

To ask the Manager in respect to NAMA if he is he aware of any  significant or potential impact and added value, that new planning  applications to this local authority will have from NAMA lands and sites, if there are now added new responsibilities impacting on the Council and does he propose to introduce new structures or procedures  at Council level to deal with this new situation?

REPLY:

The requirements and procedures for the processing of all planning applications are prescribed in the Planning and Development Act, 2000, and subsequent Ministerial regulations.

Under this legislation the Council is obliged to determine all valid planning applications, within specified timescales, and when doing so is expressly restricted to considering the proper planning and sustainable development of the area, regard being had to the provisions of the Development Plan, and various other statutory plans, orders, and guidelines.

The Council does not have discretion to decide whether or not to process any particular application, or type of applications nor does it have any control over the market values of lands/properties, resulting from any planning decision (grant or refusal).
